Win's VPN Terms of Service

Service and clickwrap acceptance
Win's VPN Inc. operates the service. Win Empire LLC designs and builds the software and infrastructure. Win's VPN is a privacy, cybersecurity, and anti-censorship technology service. Availability, speed, routing, compatibility, server locations, and payment features may vary by region, network, censorship conditions, device, platform, and maintenance status.
Before activation, the app presents bundled copies of these terms and the Privacy Policy through clickwrap. The bundled copies are condensed for the app screen and carry their own version string and document hash, which are recorded with the acceptance. This page and the Privacy Policy contain the full statements and govern if a bundled copy is shorter or less specific. By checking the required boxes and choosing Agree, the customer accepts these terms, the Verified No Log Policy, Acceptable Use Policy, hold-harmless and indemnity terms, limitation of liability, and electronic-records consent. The acceptance record may include the timestamp, document version and hash, account or free-access identity, privacy-preserving device and source-IP buckets, platform, app version, and a server-generated certificate identifier and HMAC.
Payment terms
The 1 Month and 1 Year plans are recurring PayPal subscriptions charged at the interval shown at PayPal checkout until canceled. Cancel before the next billing date in PayPal to stop future automatic payments. Canceling partway through a period already paid for ends access when PayPal reports the cancellation, not at the end of that period, and the unused part is not refunded. Verified No Log Policy
Win's VPN does not collect or keep VPN activity logs and does not log browsing history, DNS query history, traffic contents, raw VPN traffic, or destination activity. Limited service metadata is stored to operate the service. Free-access sessions also produce a 30-day connection event recording that a connection happened and which gateway served it, never what was done through it. “Verified No Log” is Win's VPN's name for these commitments and has not been independently audited or attested as of this version. Acceptable use
Customers may use Win's VPN for lawful privacy, security, education, and anti-censorship purposes. Customers may not use it for attacks, unauthorized access, fraud, spam, malware, harassment, child exploitation, copyright infringement, torrenting, payment or device-limit evasion, or activity that violates applicable law or harms people, networks, platforms, or infrastructure. Win's VPN may suspend access, preserve evidence, comply with valid legal process, and seek recovery of damages, costs, and fees caused by misuse.
Free and discretionary access waiver
Free, trial, donated, and administrator-granted premium access is discretionary, non-paid, revocable access. To the maximum extent permitted by law, users of that access receive the service without paid-service remedies, waive claims against Win's VPN Inc. and Win Empire LLC arising from the discretionary access, and remain responsible for their conduct, misuse, local-law compliance, and third-party claims. No term waives a right or remedy that applicable law does not permit the customer to waive.
Insurance notice
Win's VPN Inc. and Win Empire LLC maintain insurance-readiness controls and may seek cyber or Technology Errors and Omissions coverage. These terms do not represent that a particular insurance policy is currently bound or in force. Coverage must be confirmed from a current binder or issued policy. If coverage exists, it is governed only by the policy and is for the named insureds. It creates no service warranty, direct claim right, third-party beneficiary status, guaranteed recovery, or higher liability cap for a customer or third party.
Hold harmless and indemnity
To the maximum extent permitted by law, the customer agrees to defend, indemnify, and hold harmless Win's VPN Inc., Win Empire LLC, and their owners, officers, employees, contractors, and affiliates from claims, losses, damages, liabilities, fees, penalties, and expenses arising from the customer's misuse of the service, violation of these terms, unlawful activity, or violation of third-party rights.
Limitation of liability
To the maximum extent permitted by law, Win's VPN Inc. and Win Empire LLC disclaim indirect, incidental, special, consequential, exemplary, punitive, lost-profit, lost-data, business-interruption, censorship, connectivity, speed, geolocation, payment-provider, app-store, and third-party-service damages. The service is provided without a guarantee that every network, country, site, app, device, or censorship system will remain reachable or compatible. Non-waivable consumer rights remain unaffected.
Changes to these terms
Material changes are published on this page with a new version string and effective date, and the app requests fresh clickwrap acceptance before changed terms apply to an account. Continued use after the new version is accepted binds the customer to it. A customer who does not accept a new version may stop using the service; the billing terms govern whether anything is refundable.
Governing law and contact
These terms are governed by Florida law, without regard to conflict-of-law principles, except where non-waivable consumer law requires otherwise. English is the controlling version. Contact support@winsvpn.org.
